Think of an ESA letter as evidence, not permission. It is a licensed therapist's written confirmation that you have a disability-related need for your animal, and Las Cruces renters use it to ask a landlord to set aside a pet rule as an accommodation.
New Mexico has no statutory waiting period, so a New Mexico-licensed therapist can evaluate you and, if you qualify, your letter typically arrives by email about 15 minutes after approval. It is a clinical conversation rather than a form, and approval is not guaranteed — which is exactly why a Las Cruces property manager can rely on it.
New Mexico has its own fair housing law, but how its agency treats untrained emotional support animals after HUD's May 2026 change is still settling, so documentation quality matters more than it used to.

44.1% of Las Cruces households rent, the highest renter share among New Mexico's five largest cities. Median gross rent is $974 a month — 4th-highest median rent of New Mexico's five largest cities, against $1,145 in Albuquerque.
For a Las Cruces renter with an assistance animal, the practical problem is rarely the law — it is the listing that says "no pets" or "cats only, under 25 lbs." An accommodation request is how you ask for that rule to be set aside.

Local, state and federal rules stack on top of each other here. Each can add protection; none can take away what another gives you.
Our review did not confirm a Las Cruces or county fair housing ordinance covering disability, so this page relies on New Mexico and federal law. If one applies to your building, it can only add protection.

The Fair Housing Act still requires landlords to consider accommodation requests. Since May 22, 2026, HUD itself pursues complaints only for individually trained animals; your private right to sue is unchanged. What changed →

There is no official list of qualifying conditions. The test is whether a mental or emotional condition substantially limits a major life activity, and whether your animal helps with it. These come up most often:
Three steps. You are not charged for a letter unless the therapist approves you.
Start with a short screening so you know whether an evaluation makes sense for you before you book or pay anything.
You speak with a New Mexico-licensed therapist about your symptoms and what your animal does for you.
If you are approved, your signed letter is emailed within about 15 minutes, ready to attach to your request to a Las Cruces landlord.
Most letters reach your inbox about 15 minutes after the therapist approves you.
A card hold confirms the booking. You are charged for a letter only when the therapist issues one.
A live appointment with someone who can decline. That is the difference between a letter and a purchased certificate.
Every letter is signed by a therapist licensed where you live, with the license number on the page for your landlord to check.
Put it in writing. Two or three sentences are enough, plus your letter; a landlord's own "ESA form" is optional, not a requirement.
Verification of the license is fair; a demand for your medical file is not.
Save a copy of everything you send and receive, with dates. Paper trails win disputes.
Ask for the reason in writing, then contact New Mexico Human Rights Bureau. A HUD complaint has a one-year window.

A strong NM letter is short and specific. Here is what it needs.
Out-of-state signatures are the most common reason letters fail.
Managers check it against the New Mexico licensing board.
That you have a disability and the animal helps with it — never the diagnosis.
Most landlords treat a letter older than 12 months as stale.
A purchased certificate undermines an otherwise good letter.
A psychiatric service dog is trained to do specific work, such as grounding you during a flashback or guiding you out of a crowd. If that describes your dog, a PSD letter records those tasks, and trained animals are what HUD still enforces for after May 2026.
Pricing
The same flat price as everywhere in New Mexico. No subscription, and no charge for a letter unless a New Mexico-licensed therapist approves you.
About the PSD letter: it is documentation from a licensed therapist, not a certificate or an ID. Under the ADA, public access comes from your dog being individually trained to do work or tasks for your disability. Businesses are allowed to ask only two questions and are not allowed to require paperwork. Nobody can sell you access rights — anyone who says otherwise is selling a novelty.
You are charged only after a therapist approves you. We may place a temporary authorization hold on your card beforehand to confirm it is valid; a hold is not a charge and is released if you are not approved.
100% refund if your landlord denies your ESA. If your housing provider refuses the accommodation after you submit a letter we issued, we refund what you paid in full. Full terms, including what a claim needs, on our refund policy page.
Questions
Yes. Las Cruces follows New Mexico and federal fair housing law, and both recognize a letter from a licensed therapist as support for an accommodation request. What it will not do is work in stores, on planes or as a registration.

Since HUD's May 2026 change, a fee waiver for an untrained emotional support animal is no longer automatic federally. Ask for it in writing; whether it is required now depends on New Mexico law and your landlord. Damage is always chargeable. How fees work now →
